iPhone 13 Stuck on iOS 17.0.2 Update

I bought a brand new iPhone 13 a couple of days ago and I want to move the data from my old iPhone (XR) over to my new phone, but when I go to set this up it wants to do a mandatory update on the new phone. I have left the phones for over 6 hours and it is still stuck on the downloading screen.

I have followed lots of steps I have managed to find online, ie. freeing more space up, making sure there is sufficient battery life etc. but it still isn't working. I now have a brand new phone that doesn't work and my old phone no longer works either as my old phone number has now moved over to my new phone which I cannot use! Any help would be appreciated as I need my phone for work and keeping in touch with family.

I recently had this issue, try the below steps:

By pass the login on the new phone, that is don’t enter Apple ID on the new phone and go to software update section.
update the software to latest version
on the old phone ensure the OS is current, that is version is current and back up is taken recently.
now old phone is updated too and new one is updated too
go to old phone, under settings last option, transfer or reset iPhone
follow the onscreen instructions to setup the new phone.

Did you already try to connect in Recovery mode and restore your device?
