This issue was answered by suggesting go to Settings>Blutooth>Suggest Nearby AirPods>toggle to Off. That worked for a little while and then didn't. And yes, it still indicates off. Running tvOS 16.3.2 on TV 4K 2nd Gen.

Turn off automatic switching
If you don't want your AirPods to switch automatically, you can turn off automatic switching on your iPhone, iPad, Mac, or Apple TV.
On your iPhone or iPad
1. With your AirPods in your ears and connected to your iPhone or iPad, go to Settings > Bluetooth. Alternatively, you can go to Settings > [your AirPods].
2. Tap the More Info button next to your AirPods in the list of devices.
3. Tap Connect to This iPhone [or iPad].
4. Tap When Last Connected to This iPhone [or iPad].
5. To turn on this feature again, tap Automatically.
On your Mac
1. With your AirPods in your ears and connected to your Mac, choose Apple menu > System Settings, then click Bluetooth.
2. Click the Options button next to your AirPods in the list of devices.
3. From the Connect to This Mac menu, choose When Last Connected to This Mac.
4. To turn this feature on again, choose Automatically.
On your Apple TV
1. With your AirPods in your ears and connected to your Apple TV, go to Settings > Remotes and Devices > Bluetooth.
2. Turn off Suggest Nearby AirPods.

Sorry. That solution does not work. If Apple TV is on, the moment I put the AirPods in my ears, or even open the charging case, it connects to the Apple TV. And only Apple TV. Does not auto-connect to MacBook Pro, iPad or iPhone. Does not mater if Apple TV was the last connected device. I did verify that Suggest Nearby is toggled to off.
tvOS 16.3.3 Apple TV 4k 3rd gen. (Checked 2nd gen, no difference.)
Essentially, it appears that tvOS software is ignoring the selected mode.
