iPhone 16 pro max I was going to through the new set up process and the phone decided to do an update but now when I swipe up it goes us for half a a second then goes back to the hello screen

Try doing a restart. Volume up, volume down, hold the side button till you see the Apple logo.
I’ve tried that restart several times, holding the side button for varying lengths of time, but the phone will not restart. (And we are not able to get into the phone to do a reset.)
Exactly the same issue here. It's driving me potty and I was so excited with my new phone. Got appointment at Apple store tomorrow
I'd take it in to the Apple Store at that point.
