Lost some of my photos because I got a new phone

Hey I originally broke my old phone and all my photos were on it then they replaced it with a new phone I didn’t back up my photos originally on my old phone and I choose to use upload iCloud on my new phone. I know stupid I had some photos from 2021 but 2022,2023, some of 2024 photos were all gone and all of my text were gone also if I have my old phone serial number you think apple could send it back and I get my old photos back and old text? This would mean a lot I had tons of great memories on it. Thank you for your time
