Hey Siri asking me to unlock my iPhone for every little task

I have a 13 promax I’m running 16.3. I have the settings set that my phone does not have to be unlocked to utilize Hey Siri, this is so frustrating. I just tried to have Siri turn my do not disturb on and it’s asking me to unlock my phone. This has been going on for months. I have sent multiple feedback to Apple. I have asked Apple Support. I’ve been waiting months for an update to fix this bug. It is so frustrating it’s like having an iPhone 4.
