I checked out that article, but it does not help. There is nothing about AirPods max, just if AirPods get switched.
also, I have no way of contacting the person who sold it to me; I purchased the AirPods open box.

This alert may occur due tot he AirPods still being linked to the previous owner. If you're unable to contact the owner or direct seller, you may need to reach out to the channel in which you used to purchase them for refund options.
