Latest version of Photos

If OS X El Capitan is the newest compatible software I can run on my MacBook Pro 5, does that mean I cannot update Photos to the latest version?

Yes you are confined to the version of Photos that comes with the OS you are running.

Yes you are confined to the version of Photos that comes with the OS you are running.
