These examples come to mind:

• Are these "headphones" an Apple product?
• Were they purchased in an Apple Store?
• Were they purchased within the past 14 days?

I suggest visiting an Apple Store. They will decide what to do.

At worst, replacing the original EarPods is not a major expense.
