Replacement iPhone running older version of iOS than iCloud backup

I accidentally dropped my iPhone 12 (iOS 17) in the road... where it was then run over by a car. Thankfully, past me paid for Asurion insurance, which granted me a replacement iPhone (hooray!) however, this replacement iphone 12 is running iOS 16, so I can't use the most recent iCloud backup on my old phone. Is there a way to force an update on the new phone so that it is running iOS 17 and I don't have to restore an old backup? Or, can I restore a more recent backup once I have updated the phone?
