I think this is a bug.
this on Macbook M1 Pro, if I press fn+F5 nothing happens if I revert "function keys" to "special function keys" dictation key works just fine.
am I doing something wrong?

You're not doing anything wrong. That's the way it currently works in Ventura. I don't know if it's a bug or intentional. You can send Apple feeback.

Dictation fisical key (on F5) won't work when you swap the "special function keys" to "function keys" on system preferences....
