AppleCare with Theft and Loss

I got my iPhone stolen in another city and when I tried to locate my phone from an other device my password had been changed. 5 days later when I finally when recovered my account, AppleCare tells me I not covered because the thief was able to turn off FindMy. Is there any other course of action I should take?

iPhone 11 Pro, iOS 16
