Ultimately able to overcome by restarting device, re-erasing, bypassing all setup prompting. Incredibly time consuming, not what you would call consumer friendly
If it's not plugged in, Wi-Fi is switch Off when iPhone sleeps.
That is not good to verify/authenticate your IOS download/install with Apple server.
As said, since 2009 starting with iPhone 3G and all my iPhones with all major and minor updates, no issue whatsoever.
