Force Restart your phone. It may take a couple of attempts to get the speed and sequence of the key presses correct and the last step of holding the side button could take up to 15 seconds. Ignore anything else on the screen during that time.

Are you relying on Cellular or WiFi for the remaining apps to download? If on Cellular make sure you have Cellular Data turned on. If using WiFi, it is possible to be connected to your WiFi router and still not have access to the internet. In that case restart your router or try shutting off WiFi on your device to see if the downloads will proceed using Cellular Data if that has been allowed.

You may need to do the setup process again from your old phone if it was stopped during the setup.

I did everything you mentioned already but still not working.
can’t do the set up process again because I erased the old phone
my App Store isn’t downloaded but it’s on the Home Screen and this has never happened before since have been getting a new iPhone
do you think the iOS update is the problem here? Or the phone

It appears something may have got corrupted in the transfer process. There has not been any reports here of the App Store not being available or appearing to still be loading after an update or transfer. How you proceed will depend on if you have a backup or are syncing important data such as photos or contacts to iCloud. You can view your data that is stored in iCloud to verify it is there.

There are several resets that you can do on your phone that does not require erasing the data such as All Settings or Home Screen Layout and if you have a VPN installed, I would recommend removing it until the phone has been successfully updated.

It is more likely it will require erasing the phone through a Factory Reset, and restore from a backup file if that is an option for you.

If you are hesitant to erase the phone due to data loss, I would recommend contacting Apple directly to make sure all other options have been exhausted first.

The App Store is part of iOS and is not downloaded. It can be hidden on your iPhone if you have restrictions placed on your device. Check at Settings > Screen Time > Content & Privacy Restrictions > iTunes & App Store Purchases > Installing Apps. This should be set to Allow.

The other option is that the App Store is in your App Library and not on any of your Home Screens. In that case, swipe left on your iPhone util you see the App Library and tap in the Search Field. The apps will be displayed alphabetically and App Store will show if there are not restrictions on your device.
