so i bought a iphone 14 max from someone and shortly after im guessing they was still on the device threw icloud from the account well they activation locked the phone but i have the device under my icloud too

I don't believe you can turn off Activation Lock. You could start an Activation Lock support request, but since you are not the original owner, I doubt if Apple will consider the request.
