I did a reset and cannot pair it with it being removed from previous owner I would return it but there apparently isn’t a way to contact previous owner so I cant send back to them and cannot pair it so basically I should just throw it away?
Yep, that's pretty much all you can do with it now. Only the owner can remove it from being associated with their Apple ID. As you have seen, resetting it, does not remove it and it will be useless to you.
