When Buying an iPhone:
Have the seller perform as instructed here: What to do Before you Sell, Give Away, or Trade In your iPhone or iPad - Apple Support. They should have known better. Then, make sure you can log yourself into it, prior to handing over the money. If the seller decides not to proceed with the rules you've set forth, then do not proceed with the transaction.
