Lost mode pending, but location has been updating.

My phone was stolen yesterday, i’ve tried turn on lost mode from my laptop but it said it was ‘unable’ to, i got no confirmation email saying lost mode has been turned on but i did get an email saying apple pay has been suspended.

i then checked find my iphone on my old phone, where i don’t get an option to turn on lost mode again and it says pending. However, i’ve got a couple location updates since.

I assume that it says pending, it means the device hasn’t come online, so how could i still get location updates? Does this mean that my lost mode is not turned on properly or can the iphone (12 pro max) still be tracked when off? If it’s the latter, why is the location not updating more often?
