Is there any other way to get pass the activation lock to unpair the watch from the previous owner phone?

Just so you know and to be clear, Apple will NOT help you get into this watch. They will ONLY help you if you were the original owner and you had the original purchase receipt with the serial number of the watch on the receipt. You bought a stolen watch. It's worthless and cannot be used by you or anyone else.
Either turn it over to the police in the hopes the person who is the real owner of the watch reported it lost or stolen, or recycle the watch responsibly. Apple will recycle it and so will Best Buy.
No. If they refuse to unlock it and won't give you your money back, go to the police.
