If I erase my old Iphone will it still receive current photos and contacts from my new one since it is the same apple account? Or is that only if I back it up with Icloud?

If you are syncing photos and contacts with iCloud, once you set the old phone up again, if you sign into iCloud using Settings using the same Apple ID, and turn syncing on, the photos and contacts should sync back. The iCloud sync is very, very slow. The photos sync is extremely slow. It could take several days or more for the photos to sync.

If you aren't syncing with iCloud, then you need to restore from a backup. Even if syncing with iCloud, a backup contains other data, so you may want to restore the backup.
