If find my iPhone is turned off on a device that has been sold to me but the phone still has a passcode, can I format the device using iTunes and dfu mode and hence make use of the phone? Without there being an activation lock?

If FMiP is turned off, then you'll be able to set it up and use it after restoring ios.
You bought a locked device. Return it and ask for your money back.
Find my iPhone has nothing to do with the device's IMEI. It is a feature of Apple's iCloud service tied to an AppleID. There is no site where you can check if activation lock is enabled on a device. Apple had such a site at one time, but took it down quite awhile ago now due to possible abuses and hacks.
It's an iPhone 5 btw. Do you know any websites to check if find my iPhone is on that you would recommend using the IMEI?
I'd like to first be 100% sure that fmip is off before requesting a refund when there is no need
Web sites can't track using IMEI.
