I did a factory reset on apple tv and now my audio on remote doesn't work. I have done all the reset things but have discovered that in settings, the audio controls section will not change. I do not have the options I had previously

Are you referring to the audio settings to change the default audio from tv speakers to other or the volume on the Siri Remote isn’t working? Or the control center isn’t coming up?
first try restarting your Apple tv to see if this resolves things. Reboot wifi if using that.
Once the Apple TV is setup and signed in with your primary Apple ID you should be able to see the Apple tv icon in the Home App on another Apple device. If you click on that and use the gear icon to bring up settings you should be able to change the default audio output in that as well
