Unable to use Hearing Assistance in the UK on new AirPods 3

I have the new Apple AirPods 3 today and have been looking from Hearing Assistance on my iPhone 16.

I have gone to Accessibility and then to Hearing but there is nothing thats says Hearing Assistance.

I have clicked on Hearing Devices and it is showing "Hearing Aid Compatibility" and slide across to green but there is nothing to test.

Under Hearing Control Centre is shows me:

Conversation Boost

Headphone Accommodations

Background Sounds

Live Listen

Audio & Visual

Subtitles & Captioning

Music Hapitcs

There is nothing there for Hearing Assistance so not sure if it is my phone or new AirPods that have an issue.

What else is strange it doesnt show the AirPods in the Settings screen as soon as I go there. I am sure my old ones used to show up there and show how much battery is remaining on each one, it doesnt do that.

Should I take them back to the shop?
