No, Apple doesn’t have access to your photos. Whatever photos and videos recoverable will be in your scope, which is within 30 days from deletion. You can find them in the Photos app and scroll down to the Recently Deleted Folder.

They will remain in your Recently Deleted album for 30 days. If it has been longer than that or they were deleted from the Recently Deleted album, then you will not be able to recover them. Otherwise you can follow the steps here:
