How can I retrieve lost voice memos after iCloud sync?

I recorded some important voice memos for legal issues on my old iPhone 12 a few days ago, and i just connected it to my macbook to charge it while i airdrop the voice memos to my new iphone 16 pro. but, im not sure what happened, i think the old iphone 12 synced with my new iphone 16 pro through icloud, and now suddenly all the voice memos i took a few days ago on my old iphone 12 is gone, and its all overwritten with the voice memos i have on my new iphone 16 pro. this is ridiculous, theres no recently deleted folder on voice memo app and i cant find any of the old voice memos on icloud.com either. i really need those voice memos as it may play a crucial role in my lawsuit coming up. please help me i am furious with apple right now. this is not the first time i lose data from my device syncing with icloud, ive lost countless Notes on the Notes app that i had written because suddenly the device synced with icloud and then all the notes were overwritten. this is not ok apple.
