Brand new 15 pro max on hand updated to the latest IOS 17.03 release. I’m unable to default the camera to photos for some reason. My camera always defaults to the last shooting mode (both video/photo mode) even though the preserve the camera mode is OFF.

As you are up to date and the Camera app updates with the iOS, and restarting doesn't help, your next step will be to contact Apple for support as you've done everything you can on your end: Get Support.
