my new iPhone 14 will not update software to restore form older device

Try setting your new iPhone up as a new device instead of transferring your data, and then update the software. Once the software is updated, restore the new iPhone to factory settings to get the Setup Assistant to appear, then transfer your data.

2. Update your iPhone or iPad - Apple Support
3. After updating, restore your new iPhone to factory settings: How to factory reset your iPhone, iPad, or iPod touch - Apple Support
4. Then transfer the data from your old iPhone to the new one: Transfer data from your previous iOS or iPadOS device to your new iPhone or iPad - Apple Support
