The AirPods Max will be tied to an Apple ID which I guess was probably shared. Two humans on one ID is a bad plan, each human should have their own personal, unique Apple ID.

To answer your question... It depends who is able to connect and use the AirPods, and who has access to the relevant Apple ID (in each case, one human or both). This is potentially complicated to understand or explain...

If you can open Find My and see the AirPods Max, you still have control.

You could remove the AirPods (and your other devices) from a shared Apple ID, and setup a completely new personality leaving him on the old account.

You could change the password for the original Apple ID and lock your ex out. However, that would be a hostile act because it would probably disable his devices on the account, and he would be unable to release them from Activation Lock and setup on a new Apple ID. Depending how the old shared Apple ID is setup for security he might still be able to do a lost password recovery and get access again.

If he has the password (either changed or original) for the shared Apple ID and you are NOT able to login, then all bets are off, and the reverse of the options above are true. He can continue to track. He may also have control over the Apple ID for your iPhone. You can't break his lock unless you can access the Apple ID or he agrees to delete your devices from the old Apple ID and you setup a new ID.
