Ihave recently upgraded my phone and transferred I cloud data to my new phone I do not use my old phone but realised that my iCloud capacity is nearer to capacity when checking I’ve notice a load of data is backed up from my old phone ,if I have transferred that data to my new phone can I delete data giving me more space on I cloud

You can delete the iCloud backup for the old phone without affecting the new one. Go to Settings > [username] > iCloud > Manage Account Storage > Backups > [old phone name] > Delete Backup.

Your iCloud storage won't drop until you specifically delete the backup as described in my previous post.
Erasing the old phone as described in What to do before you sell, give away, or trade in your iPhone or iPad - Apple Support won't affect your iCloud storage.

I guess all the data is now on my new phone so the storage will drop when I delete the phone
