Can a thief remove your stolen iPhone 13 Pro Max from your Apple Account even though it was reported stolen on Find My Phone, locked and erased but still listed on your account?

not really, they usually send some Phishing - Wikipedia mail to the owner to trick them into going to a fake site and unlock the phone for them

Recognize and avoid phishing messages, phony support calls, and other scams - Apple Support


or use the phone for parts

or sell it second hand to a person who will end up with an activation locked device they can't use
