I have both new AirPods max from electronics store and when I take the ear cushions off the serial number on the right ear cup is different from the left side (on the left side it matches the serial numer by iPhone is showing)

The serial number for your AirPods Max is present on the left side of your AirPods under cushion. This number would be expected to match what you see in settings, as you've mentioned.
