My iPhone 12 was stolen and is now being used by someone else, how is that possible when the serial number is register to me??

The serial number has nothing to do with it.
Did you have Find My enabled on the device? Did you have a Lock Screen passcode set?
Did you respond to a notification that the phone had been located, prompting you to “log in”? If so, you responded to a phishing message and allowed the thief to remove the activation lock.
