i bought a ipod from a estate sale and i cant get it to open

I bought a ipod touch from a estate sale the lady had die . Is there any way i can get it open so i can use it

Not easily. The family the deceased would have to get the ID and password from Apple. With that information, you would be able to remove Activation Lock. It's probably a lot more effort for you or the seller than it is worth, but here's the info anyway:
