Do we need license to use Emoji for commercial

Hi Guys

I'm working on a project, interesting to use emojis in some artwork. Do I need a license from Apple for commercial use of it?

Thank you

Tom

Using someone else's trademarks or copyrighted works is really tricky stuff. This is really one of those cases where, if you have to ask, you are already in over your head.

The only licensing that Apple provides is documented in any covering agreements, such as a developer agreement. Generally, Apple only licenses content to be used inside apps. Any use of said content in marketing or publications is not allowed. I strongly recommend that you create your own unique content or use open source content.

Even in the case of open source content, you have to carefully read and understand the license. Most open source licenses use one of a handful of well-known licenses that are already recognized as being safe to use in commercial contexts. Plus, you have to make sure to use a source of content that is large, well-known, and known to be safe. It is common for people to re-post copyrighted content. It doesn't matter if you acquired and used copyrighted content with good intentions, you would still be infringing.

Lots of options that can or do have permissive-use copyrights… For instance: https://openmoji.org/

Or work directly with an artist, and build your own identity…

As for Apple, I’d expect you’ll open yourself to trouble, and particularly for a commercial campaign.
