See the article Delete and recover photos and videos on iCloud.com - Apple Support

Deleted photos and videos are placed in the Recently Deleted album, where they remain for 30 days before being permanently removed.

om

When you delete a photo or video from Photos on iCloud.com, it’s also deleted from all your devices that have iCloud Photos turned on. If you change your mind, you have 30 days to recover it before it’s permanently deleted.

If you just got a new iPhone, I would ask Apple Support for help. Your photos may still be available on Apple’s own backups of iCloud, that are not available to the users. Apple might be willing to help a new customer to get the photos back, if you accidentally deleted your photos when setting up a new iPhone. It is unfortunately an easy to make mistake.

When I have been referring to backups on a computer, I thought you might have saved your photos on a computer, for example with iCloud for Windows or iCloud Photos on a Mac. If you have been syncing iCloud Photos with a Mac, for example, Time Machine may have been saving your Photos.

This is due to you not understanding - or misunderstanding - how iCloud works, it's not just cloud storage - like Dropbox - it also offers cloud computing (like MS Office 365 and OneDrive), but it also automatically syncs your files and photos across all your devices - and this is where novice users come unstuck, because this feature is set on by default and it means that, if you delete a file, photo or video from one device, it's deleted from all your devices - and, crucially, also from the cloud. My parents fell afoul of this when they deleted some photos from their iPad, including photos of close friends golden wedding party (the wife died a few months later). Thankfully, of course, they were able to get them replaced from her husband.

This feature should be set to off by default; Apple needs to recognise that many people aren't technologically-minded - or it should at least make it clear that it's switched on. Sometimes Apple's desire for simplicity makes things complicated.

What Leonie is saying that you can access your deleted photos from your backups (you do have backups, right?). If you don't have a backup, then your photos are gone. What's happened to you is a consequence of iCloud functioning as designed.
