If you can return it to the seller, do so, or have them remove the lock. If you bought it through a service such as eBay, file a claim. Otherwise recycle it, you cannot remove Activation Lock. See: Activation Lock for iPhone, iPad, and iPod touch: https://support.apple.com/en-us/HT201365

Unfortunately we cannot help you with this and neither can Apple. Get in touch with the person/person’s that you got it from and have them remove it. If they cannot/will not…get a refund. If you bought it through…say for example…eBay…file a return for your money back. If you cannot do any of those things …recycle it responsibly as you will not be able to use it.
