I have the same issue. My songs were downloaded from CDs back in the day. When i got divorced guess what happened to them - as the EX. I am 71 years old and enjoy my classic rock and roll. So you are telling me that due to your iron hand, jack booted rules that i cant move what is left of my music to my newer phone. So, the ex screwed me twice. What an absurd position to take. You have no liability in this, it is strictly me. the music was legally purchased and illegally removed from my possession by my ex. Not worth hiring a lawyer for. If there is no way around this, then this is the absolute last Apple purchase i make until the day I die. I may die soon but I wont die with an Apple product in my hand, it will be another brand. Adioss!!!
