Icloud
If my pictures are backed up to my iCloud, and then I erase all my data on my phone. Then I get a new phone can I put my pictures from the cloud on my new phone

Once you store your photos in iCloud, there's nothing to do when you get a new device but simply to enable the appropriate iCloud settings which in this case would be iCloud Photos - Set up iCloud on your iPhone, iPad, or iPod touch - Apple Support & Set up and use iCloud Photos - Apple Support.
