How to request access to a deceased family member's Apple accounts - Apple Support provides some information for you.

Although you are not specifically asking for access to the decedents account, the same policy will apply for removal of the Activation Lock on that device.

Unless someone from the decedent’s family knows their Apple ID and password then there is nothing that can be done with that device. The activation lock is meant to be a theft deterrent system so there is no user work around
