back up to new iphone
I am try to backup a new iphone from my older phone. But i keep getting the message of not update to date ios to complete it the backup in itunes. Help

Perhaps your old iphone, when you created that backup, was running a higher iOS version than the one that's running on your XS Max.
Should be this case, you need to update your XS Max to to the newest iOS version, before restoring from backup.

Refer to this guide: https://discussions.apple.com/thread/250430811?answerId=250831253022#250831253022 You need to create an iTunes backup of your 8 Plus running 12.3.2 and then edit that backup to work with your new phone.
In fact the latest iOS version for all iphones is 12.3.1, except iPhone 8+.
Owning an iPhone 8+, you could have a 12.3.2 iOS version on it. That was a particular update for 8+ devices ONLY.
Making a backup using 12.3.2 iOS version, does not fit (you CAN'T restore) into a device that's running a 12.3.1 iOS version. That doesn't work.
So, follow the suggestion that Elitegate gave you in his previous post.

Did you read the thread carefully? Did you open the link and did you read that thread as well?
XR has iOS12.3.1, 8+ has iOS12.3.2. You only can restore a backup between two devices with iOS on the same status or from older iOS to a newer one. But in your case 12.3.2 is newer than 12.3.1!!!
Yes that is what i meant. I have not added all the other devices running iOS 12, because people upgrade from the 8 Plus to the Xr / Xs / Xs Max usually. But yes, 12.3.1 is indeed the latest version for all devices running iOS 12, except for the 8 Plus which gets 12.3.2. :)
Elitegate, I'm sure you understand, and please don't consider me too meticolous.
But we must try, as far as possible (nobody is perfect here), to always give correct and complete answers to the OPs.

"betcha" your old iPhone is iPhone 8!
Let's see if the OP has 8+ (Iphone 8 can't run 12.3.2)

But be careful! This procedure should only be done by users who really know what they're doing. Otherwise wait for iOS12.4.
xs max keeps telling me software is up to date.
Yes because 12.3.2 was only released for the 8 Plus. For the Xr / Xs / Xs Max, 12.3.1 is the latest version.
Elitegate, just for clarification:
You could have stated: "for all iPhones that support iOS 12 or later". Your list is a little bit restrictive.
Add: 5s, 6, 6+, SE, 6s, 6s+, 7, 7+, 8, X. :-)
