So the launch of the 17 line was a few days ago, but i'm not seeing the 16 pro max on the page anymore. Would i still be able to purchase one from apple or would i have to purchase second hand?
No, you won't be able to buy one from Apple itself. You can check with Authorized Sellers, like your carrier or for example BestBuy in the US if you want to buy a 16 Pro Max.

If you're not in the US, then you shouldn't be trying to buy your phone from the US. At this point, only carriers and stores like BestBuy may have them in the US and they WON'T be unlocked. Also, if you magically found one in the US (again, it won't come from Apple directly) yet you don't live in the US, your phone will NOT have warranty outside the US.

I would suggest that you consider purchasing an unlocked iPhone 17 Pro Max directly from Apple.

There's also the little matter of it being available (after preorders are filled) whereas the iPhone 16 Pro Max isn't.
The other thing you could do is to watch the Apple Certified Refurbished Store to see if any iPhone 16 Pro Max models show up there. There's no way of knowing when that would be, or which specific configurations might become available, but it is logical to assume that some will show up there sooner or later.
