I have my Apple menu bar set to grey but recently every now and then it switches to black and I have to turn the black option off under general settings. Any idea why this is happening and how to fix this permanently? I haven't installed anything. Two images attached below.

you can Login and test. Reboot as normal and compare your results. Caches get rebuilt automatically.
I don't use Dark Mode at all personally, but I generally find the background bleeding through the menubar a distraction.
Settings > Accessibility > Displays ...
...Reduce Transparency ON
I just tried this and on the first attempt it said the disk repair failed. On the the second attempt it said the disk is ok but when I restarted the menu bar was black again.
It seems to happen after waking up from the screen saver. At least this is one occasion but there are others.
Any thoughts? Is it possible to be a virus?

Please explain what I would be testing. Remember that the issue is random and I have no idea what causes it to switch to black.

Typically, The Menubar will switch white-on-black <-> black-on-white when a background swallows the text and makes it less than 50 percent visible.
That is why I just turn transparency off.
I believe I have found the solution. I use an app called flux which was set to: Color Effects>macOS dark theme at sunset. After disabling all the color effects the issue hasn't re-occurred.
