I bought this device used, and it didn't have garage band when I purchased it. When I try to download from the Apple store, it says no can do, I need a more recent macOS.??

You can try to install an older Version from a disc? older MacOsX install have the package as optional install.

If you cannot get to a version that the current version on the App Store can support, you are not able to download GB.
