Is it possible you are logged into any other Apple devices using that same Apple ID and password? If so just go to the settings, your name at the top, password & security and change the password there.
If you don't have any other Apple devices you'll have to do an activation lock removal. Please see this article, review, and click the link at the bottom to start the process. Keep in mind you'll need proof of purchase for Apple to remove the Apple ID from the device. Once Apple removes the activation lock you'll have to restore it to factory settings.
