No. The watch isn't waterproof, the watch is water resistant.
But if you did something that damaged the watch's water-resistant seals before taking it swimming, then the water could ruin the watch.

then Apple should remove the Swimming Activity in the apps, and say don’t use it for swimming. Otherwise it is deemed defective if it doesn’t work after swimming when Apple claims that it is swimming ready.

Read my comment again. I did not say that. I said that you may have had a mishap with the watch in some way to damage the water seals.
Would you know what possible mishaps could damage the seals? I’m trying to backtrack if that is the case.

Apple warns that chemicals can eat at the seals. Did you wash the car wearing the watch? Did you possibly shower with body wash, shampoos or other soaps and lotions?
