My iPad won't let me do a software update?

I am trying to update my iPad, but it is saying my software is up to date, but it is on iOS 9.3.5

That would be correct. A first generation iPad mini cannot update beyond iOS 9.3.5 so for it 9.3.5 is up to date.

With previous information in hand, the only option is to purchase a newer or New iPad to run the current iOS version 15.2
