If this was purchased from Apple, then contact Apple Support.

Why the Wait:
It may be a used return -- one that was mistakenly, never disassociated from an account(which has happened to me, in the past). Phone calls are taking a bit to go through at the moment, due do lots of calls. With the Coronavirus Pandemic, many are at home at the moment, with much time on their hands to contact Apple. So, just stay on the line, and you will get through :)
If this was purchased off of a Web site (i.e. eBay), then contact the site, seeing if the seller can be held accountable, and if you can get your money back.
If this was purchased in-person somehow, then take it up with that person.
Activation Lock is a theft deterrent feature with no bypass or workaround.
Without the owner's authorisation (Apple ID & password), no thief or anyone including you can re-use the device.
You will never be able to use this iPhone, please recycle the iPhone responsibly
If you do not have the Apple ID and Password to remove the activation lock then there is nothing that you can do about it. That iPhone will never work for you without those credentials.
