Hi apple have taken £38.99 from me

If you don't know why, start here and check the appropriate section (Purchases, Subscriptions, Unfamiliar charges, Request a Refund):--> Subscriptions and Billing – Official Apple Support

Apple will judge (and let you know) if your request is eligible for a refund.
