I have a Mac Mini from early 2009, Can i upgrade to El Capitan

Yes. Back up your data, check your applications for compatibility, and download El Capitan. If your Mac is running 10.5.8 or earlier, you'll either need to go through Snow Leopard or create an installation thumbdrive from the download.
