I have osx El Capitan and do not know how or if I can update it. Because of this I can not get my photos from i-photo.

Which model of Mac (including date) do you have? We need to know that before determining whether it can be upgraded.
Also, what happens when you try to get your photos?

The icon for I photo is still there and it won't open. I did not see the photo app until I went to the launch pad. So now I am moving my photos there I think.

You don't need to move photos - just run the Photos application and it should move them for you.
