Do not disturb regime

Providing Apple with your feedback is the way to go about this. Apple does not necessarily read these forums on their own time and will. So, let them know how you think this should be configured. Apple's tech's wont get back to you on this directly, but they'll most certainly see your feedback, perhaps taking it into further consideration in updates yet to come.

1. Go Here: Feedback - iPhone - Apple
2. Select: "Feature Request" for the "Feedback Type"
3. Proceed from there as necessary.

If Do Not Disturb is turned off, neither of those options have any effect on your phone. Something else is causing the problem. Have you checked the mute switch? It's the slider above the volume buttons.
